What these terms cover

The HypAware CLI is open source under the MIT license, and that license governs the code. These terms govern your use of HypAware Cloud and this website, and your use of the CLI to connect to HypAware Cloud. If you signed a Design Partner Addendum with us, it applies too, and it wins where it conflicts with these terms.

Early access

HypAware Cloud is an early product offered free of charge to design partners. There are no fees, no uptime commitment, and no support commitment. Features will change. Either of us can stop at any time. If we introduce paid plans, we will tell you before anything is charged, and nothing is charged without your agreement.

Your use

Use HypAware lawfully. Record and sync only AI activity you have the right to collect, including conversations, code, and tool output. Keep your account, tokens, and machines secure, and tell us if a credential is lost. Do not misuse or disrupt the service, probe it without permission, or try to reach another organization’s data.

Your sessions contain your team’s work. Before you connect a machine to an organization, the people whose work is recorded need to know what is recorded, that it is synced, and that every member of the organization can read it. Giving that notice, and getting any consent your local law requires, is your responsibility.

Your data

You keep all rights to the sessions and other data you sync (“your data”). You give us permission to store, process, and display it to operate HypAware for you, which includes sending query results over your data to Anthropic to generate your reports. The Privacy Policy and the Security page describe who can see your data and where it goes. Read them before you sync.

We do not use your data to train models. We may use information about how the product is used, with your content removed and combined across customers, to improve product performance and customer experience.

Where your data includes personal data, the Data Processing Addendum at https://hypaware.ai/dpa/ is part of these terms. A countersigned copy is available on request.

You can ask us to delete your data at any time by writing to legal@hyperparam.app. There is no self-service deletion for synced data today. We delete by hand within 30 days of your request or of the end of these terms, and backup snapshots expire 14 days after that. Data already sent to Anthropic to generate a report is held by Anthropic under its own retention terms.

Confidentiality

Your data is your confidential information. We use it only to provide HypAware to you, we limit access to people who need it to do that, and we protect it as described on the Security page. Anything we share with you that is marked or obviously confidential, including unreleased features, is ours, and you agree to keep it to yourself. Neither of us is bound for information that is public, already known, or independently developed.

Feedback and publicity

If you give us feedback, we can use it without restriction or payment. We will not use your name or logo, and we will not publish findings from your reports, even without your name, unless you approve it in writing.

AI-generated reports

Reports are written by an AI model and reviewed by a person at Hyperparam. They can still be wrong. Check a finding against its evidence before you act on it, and review any change before you apply it.

Updates to the CLI

When installed globally through npm, the HypAware daemon checks for new versions about once a day and installs them. You can turn this off by setting auto_update to false.

Other services

HypAware records activity from AI tools you already use. Your use of those tools stays under their own terms, and you are responsible for following them.

Suspension and ending

You can stop using HypAware at any time. Run hyp leave on each machine to stop syncing, and ask us to delete your data. We can suspend access for misuse or to protect the service or other customers, and we can end the early access program with notice to organization admins. The sections on confidentiality, feedback, warranties, liability, and governing law continue after these terms end.

No warranties

HypAware is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows.

Limit of liability

To the extent the law allows, neither of us is liable to the other for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data.

Changes

We may update these terms. When we do, we change the version below, and you will be asked to accept the new version the next time you sign in to HypAware Cloud. For the website and the CLI, continued use after an update means you accept it.
